Paint Your Life – California Consumer Privacy Act (CCPA) Notice at Collection

Pursuant to the California Consumer Privacy Act of 2018 as amended (“CCPA"), this Privacy Notice (hereinafter the "California Privacy Notice" or "Notice") supplements the information contained in Our privacy policy (the “Privacy Policy“) and applies solely to Users (as defined in the Privacy Policy) residing in the State of California (“California consumers”), and addresses the rights that such California customers have in information “sold” or “shared” by Us, as defined in the CCPA, in the last twelve (12) months.

We may change this Privacy Notice from time to time. The last revision date will be reflected in the “Last updated” heading located at the top of this Notice. Any changes to this notice will become effective when posted unless indicated otherwise.

The terms "personal information", "business purpose", "commercial purpose", "sale" and "service provider" as used in this Notice have the meanings ascribed to them in the CCPA. Any other capitalized terms used but not defined in this Notice will have the meanings set out in Privacy Policy. If there is any conflict or inconsistency between the terms of this Notice and the Privacy Policy, the terms of this Notice will govern.

1. CATEGORIES OF PERSONAL INFORMATION WE COLLECT FROM CALIFORNIA CONSUMERS

In the preceding 12 months, we have collected the following categories and types of personal information from California consumers, and intend to continue doing so subject to the requirements under the CCPA:

Personal Information does not include publicly available information or lawfully obtained, truthful information that is a matter of public concern, information that is de-identified or aggregated with other consumer information, or information that falls outside the scope of the CCPA.

2. HOW WE COLLECT YOUR INFORMATION.

We collect most information directly or indirectly from you through your use of the Platform, your voluntary provision of information to us, and via third party sources that have obtained your consent to provide such information.

3. BUSINESS OR COMMERCIAL PURPOSE FOR COLLECTING, SHARING AND SELLING INFORMATION.

We collect and share your personal information for the following Business Purposes and Commercial Purposes: to authenticate you when you use our websites, to provide customer support, to audit our products and services, to detect security incidents, to debug and fix errors associated with our websites, research, activities to maintain the quality of our websites and products and services, to encourage and enable purchases such as through our various promotions, to provide personalized marketing offers and programs, to enroll you in our newsletter subscription program, and other commercial transactions that occur from time to time.

We do not make your data publicly available, we do not act as data brokers and we do not trade in your data. However, certain standard generally accepted business practices may be deemed as "Sale" or “sharing” of data under the CCPA, such as when we utilize third party service providers that provide us with services, while they retain certain rights to use your data for their own business needs (e.g. Google Analytics, Facebook, fraud detection services, our online marketing service providers, etc.).

If you are a California customer, and wish to request to opt-out of certain disclosures or transfers in which we participate that constitute either a “Sale” or “Sharing” of your personal information, please refer to section 3 - "Your California Consumer Rights" below, for information on how you can exercise your rights.

4. DISCLOSURE OF PERSONAL INFORMATION.

We may share your information, including personal and sensitive personal information, with our Service Providers in order to perform services specified by a written agreement. In addition, we may share personal information with our affiliates and subsidiaries, vendors working on our behalf, or when required by law or in relation to legal process.

5. YOUR CALIFORNIA CONSUMER RIGHTS.

California consumers may make a rights request by submitting a respective request to privacy@paintyourlife.com or by filling out our online form. Your request must include sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information, which may include your email address and name, as well as a description of your request with enough detail for us to properly verify your identity, and understand, evaluate, and respond to your request.

If you would like, you can permit someone to submit a request on your behalf (an “Authorized Agent”). If an Authorized Agent sends a request on your behalf, we will ask that person to give us proof that you have provided them with written permission to make a request on your behalf. If that person does not provide such written proof, we will deny your request in an effort to protect your personal information.

Right to Access

California consumers have the right to request access to the specific pieces of personal information we have collected about them in the last 12 months. You may make this request up to two times in a 12-month period.

You may also request additional details about our information practices, including the categories of personal information we have collected about you, the categories of sources of such collection, the Business Purpose or Commercial Purpose for selling, sharing, or otherwise disclosing your personal information, as well as the categories of third parties with whom we share, sell or otherwise disclose your personal information, in the preceding 12 months.

Right to Correct

If you are a California consumer, you also have the right to request the correction of inaccurate personal information.

Right to Delete or Limit

You have the right to request that we delete any of your personal information that we have collected from you and retained, subject to certain exceptions. Once we receive and confirm a consumer request, we will delete (and direct our Service Providers to delete) your personal information from our records, unless an exception applies. To delete your information, you may send a request to us by filling this contact form.

Right to Non-Discrimination

We will not discriminate against you for enforcing your CCPA rights, Unless otherwise permitted under the CCPA.

Right to Limit or Opt-Out of the Sale or Sharing of Your Information

We don’t provide your name, phone number, address, email address or other personally identifiable information to third parties in exchange for money. However, under California law, sharing information for instance for advertising purposes may be considered a Sale of Personal Information. If you’ve visited our digital properties within the past 12 months, Personal Information about you may have been Sold or Shared with our advertising or other partners for their own use.

You have the right to limit the use and disclosure of your personal information to whatever use is necessary for us to make the Platform available to you. In addition, California consumers have the right to completely opt out of the Sale or Sharing of Personal Information. We’ve made it easy for anyone to stop the information transfers that might be considered a Sale or Sharing under the CCPA, and you can do so by submitting a respective request to privacy@paintyourlife.com. Your request must include sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, which may include your email address and name.

Additionally, California consumers may opt-out of the "sale" of information as described above, by changing their Privacy Preferences.

Please note that by opting out of the Sale or Sharing of your Personal Information

  • You may still see some tailored advertising that third parties may have previously collected unless you opt out of all interest based advertising (see our Cookies Policy or visit www.aboutads.info/choices)
  • We will still share your personal information with our service providers to provide the services on our websites
  • These settings may not persist if you clear your cookies, switch devices, or switch browsers. If you access our websites from other browsers or devices, you will also need to make this selection on each browser and device. If you delete or clear cookies, you’ll need to click the button again the next time you visit. If you delete or clear your cookies, that will delete our opt-out cookie and you will need to opt out again. If you have previously requested that we do not sell your personal information, your request remains in effect until you tell us otherwise.


6. MINORS.

We take reasonable care to ensure that we do not sell or share the personal information of consumers that are less than 16 years of age (a "Child”), unless the Child is at least 13 years of age or their parent or guardian has affirmatively authorized the sale or sharing of the Child’s personal information.
